Terms of Service

Welcome to BuiltByMe.ai. These Terms of Service ("Terms") govern your access to and use of the BuiltByMe.ai platform, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using BuiltByMe.ai, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Your continued use of the Service after any modifications to these Terms constitutes acceptance of those changes. We recommend reviewing these Terms periodically to stay informed of any updates.

2. Description of Service

BuiltByMe.ai is an AI-powered web application generation platform that allows users to describe applications in natural language and receive fully functional, deployable web applications. The Service uses artificial intelligence models to generate code, design layouts, and produce web applications based on user prompts.

The Service includes, but is not limited to: AI-powered code generation from text and image prompts, automatic deployment of generated applications, hosting of deployed applications, iterative editing and refinement of generated code, and access to subscription-based credit systems for generation usage.

3. User Accounts

To access certain features of the Service, you must create an account by providing accurate and complete registration information, including a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately at support@builtbyme.ai if you become aware of any unauthorized use of your account or any other breach of security. We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if your account poses a security risk to the Service or other users.

4. Subscription Plans and Payments

BuiltByMe.ai offers a free tier and multiple paid subscription plans. Paid plans provide monthly credits that are used to power AI generations. Credits are consumed based on the complexity and length of each generation request. Subscription credits reset at the beginning of each billing cycle, and unused credits from a subscription period may expire up to one year from their issue date.

All payments are processed securely through Stripe. By subscribing to a paid plan or purchasing a one-time credit pack, you authorize us to charge the payment method provided via Stripe on a recurring or one-time basis, as applicable. Subscription fees are billed monthly in advance.

You may cancel your subscription at any time. Upon cancellation, your subscription benefits will remain active until the end of your current billing period, after which your account will revert to the free tier. We do not offer refunds for partial billing periods, unused credits, or one-time credit pack purchases, except where required by applicable law. If you believe you are entitled to a refund due to a billing error or technical issue, please contact support@builtbyme.ai.

5. Generated Code Ownership

You own the code and applications generated through your use of the Service. Upon generation, all intellectual property rights in the output code are assigned to you. BuiltByMe.ai retains no ownership rights, licenses, or claims over the code generated for you. You are free to use, modify, distribute, commercialize, and sublicense your generated code without restriction.

However, you acknowledge that AI-generated code may include common patterns, libraries, or frameworks that are publicly available and not proprietary. BuiltByMe.ai does not guarantee that generated code is unique or free from similarity to code generated for other users or to publicly available code.

6. AI-Generated Content Disclaimer

The code and applications generated by BuiltByMe.ai are produced by artificial intelligence models and are provided on an "as is" basis. While we strive to produce high-quality, functional output, we make no guarantees or warranties regarding the correctness, completeness, security, performance, or fitness for any particular purpose of AI-generated content.

You are solely responsible for reviewing, testing, and validating all generated code before deploying it in any production environment. BuiltByMe.ai shall not be liable for any damages, losses, security vulnerabilities, data breaches, or other issues arising from the use of AI-generated code. We strongly recommend conducting thorough code review and security audits on any generated application before making it publicly accessible.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to:

• Generate applications that contain malware, viruses, or any form of malicious code
• Create applications designed to facilitate illegal activities, fraud, or phishing
• Produce content that is defamatory, obscene, harassing, threatening, or that violates the rights of others
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or proprietary systems of the Service
• Overload, disrupt, or interfere with the Service or its infrastructure through automated or excessive requests
• Generate applications that collect personal data without proper consent or in violation of applicable privacy laws
• Resell, redistribute, or white-label the Service without written authorization from BuiltByMe.ai

We reserve the right to remove any generated content and suspend or terminate accounts that violate these acceptable use guidelines, at our sole discretion and without prior notice.

8. Third-Party Services

The Service integrates with and relies on third-party services to provide its functionality. These include, but are not limited to: Stripe for payment processing, Supabase and MongoDB for data storage, Netlify for application deployment and hosting, and Amazon Web Services (AWS) for file storage. Your use of the Service may be subject to the terms and conditions of these third-party providers.

BuiltByMe.ai is not responsible for the availability, reliability, or performance of third-party services. We are not liable for any losses or damages arising from outages, data loss, or security incidents caused by third-party service providers. We recommend reviewing the terms and privacy policies of these third-party services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUILTBYME.AI, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO BUILTBYME.AI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or through a notice on the Service. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of those changes.

If you do not agree with the modified Terms, you must discontinue your use of the Service and close your account. It is your responsibility to review these Terms periodically.
